The LEUP Process

To qualify for a LEUP you have to answer NO to the following questions....

Are you under 21 years of age?

Are you under indictment or have been convicted of a crime punishable by imprisonment exceeding one year?

Are you a fugitive from justice?

Are you an unlawful user of or addicted to marijuana, depressants or stimulants or narcotics?

Have you been adjudicated as a mental defective or have been committed to a mental institution?

If you answered YES to any of the above questions STOP HERE, you cannot get a LEUP.

Next you will have to determine if you can meet the storage requirements. Basically this means a Type3 or Type4 magazine which is located at least 75 feet from an inhabited building.  These are the federal requirements. Your local requirements takes priority though. If your town says no explosive magazines then you are out of luck and will have to go the contigency storage option. If your town allows and have a secure detached garage or storage shed that satisfied the 75 foot distance you are all set.

If you cannot meet the storage requirements you may be able to get a storage variance. Applying for a storage variance with your LEUP application will typically extend the time it takes to get your permit. The ATF will usually grant a variance to be able to place your magazine in an attached garage of a single family residence if you can meet the following conditions:

    Your local and state laws allow it.

    The local “authority having jurisdicion”, usually your town fire marshall approves.

    There is a 1 hour fire rated wall separating the garage from the living space.

    You store your igniters and ematches in a second separate magazine.

     

If you are unable to get a storage variance then you must arrange contingency storage of your motors and regulated materials. This means either you store your materials in another LEUP holder’s magazine or have a dealer agree to take back or store motors you do not use.
